Red stripes

Once upon a time I graduated from law school, was admitted to a couple of state bars, and then promptly dropped the whole thing. But some legal stories do continue to catch my eye.

The Fashion Law ran a story with an interesting twist on trademark infringement. Forever 21 is taking the initiative to bring suit against Gucci’s claim that they hold trademark rights over particular stripe combinations – blue/red/blue and green/red/green specifically. According to Gucci’s registered trademark, any use of blue or green stripes with a red stripe in the middle is an infringement of Gucci’s intellectual property rights and constitutes brand infringement. Now I don’t have any particular sympathy for Forever 21, which has reportedly stolen from many, many small designers. But Gucci – I don’t think you have a case against my vintage striped jacket.
